WALL STREET JOURNAL:ANWAR SUPPORT ALL EFFORTS TO PROTECT THE STATE OF ISRAEL!

salam kepada semua...

KUALA LUMPUR—Malaysian opposition leader Anwar Ibrahim said he isn't worried about state prosecutors' move to appeal a court decision acquitting him of sodomy earlier this month, and said he remains confident it won't derail his campaign to lead a new government to power in elections expected later this year.

"The judgment [in the sodomy case] was very strong" and "difficult to appeal," Mr. Anwar said in an interview with The Wall Street Journal at his political party's headquarters here Thursday. He said the appeal process, which began Jan. 20, would likely take at least six months, meaning it could loom over and outlast the election campaign.
Prime Minister Najib Razak has to call an election by March 2013, but under Malaysia's parliamentary system of government, many analysts predict it will be called much sooner, triggering one of the most fiercely fought electoral contests this resource-rich nation has ever seen. Mr. Anwar said he believes the election is unlikely to take place later than June.
Since the Jan. 9 verdict by a High Court judge—who acquitted Mr. Anwar of violating Malaysia's strict sodomy laws citing a lack of witnesses and flawed DNA evidence—the 64-year-old opposition leader has begun mobilizing support in this multiracial country, promising reforms to dismantle a decades-old affirmative-action program designed to give a leg up to the majority ethnic-Malay population while also targeting what he describes as widespread cronyism in Mr. Najib's government. If elected, Mr. Anwar said he will accelerate privatizations and do more to enable free markets to operate more efficiently, such as improving transparency in the bidding for government contracts.
Mr. Najib, 58 years old, is also keen to brand himself a reformer in part to win back ethnic-Chinese and Indian voters who in recent years largely have thrown their support behind Mr. Anwar's opposition alliance. Mr. Najib has also embarked on a series of sales of government assets to spur growth. Earlier this month, a government state investment fund sold its stake in car marker Proton Holdings Bhd. to conglomerate DRB-Hicom Bhd., and last year government-linked funds swapped shares in state-run Malaysian Airline System Bhd. with budget airline AirAsia Bhd.
"The overall principle is that we want the government-linked companies to sell off their noncore and noncompetitive assets," Mr. Najib said in an interview two weeks ago. "We are always looking out for how to add value to the country."
Mr. Anwar, though, criticized the way Mr. Najib's government pursued these privatizations, saying that without open, public tenders, key companies remain controlled by a well-connected few.
Privatization "looks good, but look again at the procedures," said Mr. Anwar. "The issue is not about privatization, it is blatant corruption."
Following the Proton deal, state investment fund Khazanah Nasional said in a statement that it chose the best suitor for the job and the country.
A Malaysian government spokesperson said Thursday the government is "fully committed to openness and transparency in all privatizations and divestments of state-owned assets and to tackling corruption wherever and whenever it is found." The spokesperson noted that Malaysia has introduced a new online database of government contracts so that anybody can alert authorities to any potentially improper actions.
"We are determined to ensure that all government contracts are awarded through a process that is fair and open to scrutiny," the spokesperson said.
After being embroiled in the sodomy trial—which he claims was politically motivated—Mr. Anwar is now shifting gears from defending his reputation to fighting to win an election.
Once a high-ranking member of the United Malays National Organization that has run Malaysia since independence from Britain in 1957, he was sacked from the party and lost his post as deputy prime minister after challenging former leader Mahathir Mohamad in the 1990s. He was subsequently charged for sodomizing his driver and his speechwriter, and spent six years in prison before his conviction was overturned.
After leading the opposition to one of its strongest-ever showings in 2008's national elections, Mr. Anwar was accused by former aide Saiful Bukhari Azlan of sodomizing him, setting in train another marathon, headline-stealing trial which Mr. Anwar again said was designed to end his political career. Mr. Najib and his government have repeatedly denied having anything to do with the case.
Now, after Judge Zabidin Diah acquitted Mr. Anwar, ruling that the forensic evidence presented against the opposition leader was flawed, Mr. Anwar argues that he isn't just "anti-UMNO" but has his own set of policies geared toward restoring Malaysia's competitiveness in a global economy where countries such as Vietnam and Indonesia are emerging as alternative magnets for investment.
"We must always compare Malaysia to Singapore, South Korea and Taiwan," said Mr. Anwar. "That's what we were."
If elected, Mr. Anwar said he would speed up the removal of racial quotas for university places and focus on helping lower-income groups regardless of race instead of solely aiding ethnic Malays.
In the interview, Mr. Anwar also clarified his position on homosexual rights and Malaysia's sodomy laws, and also the Muslim-majority nation's relationship with Israel.
"I support all efforts to protect the security of the state of Israel," said Mr. Anwar, although he stopped short of saying he would open diplomatic ties with the Jewish state, a step which he said remains contingent on Israel respecting the aspirations of Palestinians. Malaysia has consistently refrained from establishing diplomatic relations with Israel, although limited commercial ties exist between private companies in the two countries.
In response to recent local reports that he supported gay marriage, Mr. Anwar said they were wrong and that he "believes in and supports the sanctity of marriage between men and women." The opposition leader is suing government-linked newspaper Utusan Malaysia for defamation, alleging that it implied he supports and wants to legalize homosexuality.
Still, Mr. Anwar said that Malaysia's sodomy laws are "archaic" and could be amended.
"It is not my business to attack people or arrest people based on their sexual orientation," he said.

'Malaysia’s biggest challenge is democracy'

On January 9, former deputy prime minister of Malaysia, Anwar Ibrahim was acquitted of charges of sodomy after a two and half year court trial. In 2008, going to prison for sodomy sealed his political career at a time when he was a front runner for the seat of prime minister.
After a relentless battle against his political rivals at home, Ibrahim has now embarked on a mission to bring about democratic reforms in Malaysia.
As the leader of the opposition he is steering Parti Keadilan Rakayat (PKR) against the ruling coalition, United Malays National Organisation (UMNO), headed by prime minister Najib Tun Razak.
During his one-day visit to Mumbai (India) he speaks about the ordeal of being charged for sexual harassment, along with the serious economic crisis and authoritarian government in Malaysia. Excerpts of the interview with Shubhangi Khapre.

Why were you sceptical about getting a fair trial?
My apprehensions about getting a fair trial were based on the fact that I was framed on flimsy charges without any evidence and I was punished. The prime minister Najib (Tun Razak) had personally met the complainant. The case was being tried by a single judge and anybody who dares to stand as a witness was being intimidated by police. The prosecutor was not being allowed any access to the medical report of the doctors of the complainant. There was no way to corroborate what was being presented to the court was correct or not. My defence was kept in dark.

At the end, the courts pronounced you not guilty. Is this a sign of judiciary moving towards reforms independent of government pressure?
One swallow does not make a spring. I am not sure if this can be construed as a move towards reforms in judicial system as yet. I am not sure. All I can state is that the court had to give this verdict because of international defence expert who demolished the evidence produced in the court.
The DNA submitted by the prosecution was unreliable. The going for the government was getting tough because of public opinion against the trial where it was clear that I was being wrongly accused out of political vengeance. The international pressure might have forced the government to rethink it's decision.

Can you throw some light on the time between 2008 and 2012 when you underwent trial?
I sarcastically told some of my close friends how much the government 'cared for me' during the trial. They deployed the senior inspector general of police to physically torture me in prison. At least they cared about the stature. The job was not left to ordinary police constables. What could I have expected of them? Whether it was media, judiciary, police or politicians everybody was under government control. Can you imagine how this whole ordeal must have affected my wife and children? The charges tarnished my image internationally. The government-controlled media wrote malicious reports about me and my family. In one report they even questioned as to why my wife (Dr Wan Azizah) was not seeking a divorce. Throughout the trial I was being maligned. Sometimes people say I have a Hindu agenda, and other times they call me a Christian agent. My views on reforms are construed as anti-Islam. I have always been an advocate for multi-culture and multi-ethnicity. I went through terrible agony as my honour and self-respect were targetted.

Why do you think you were framed?
During Prime Minister Mohammad bin Mahathir's term, I had questioned the corruption in the government.
As the deputy prime minister I had tabled an anti-corruption bill in the parliament which was not appreciated. There was a lot of resentment as cabinet colleagues did not approve of the bill.
Mahathir and others were afraid of being penalised for wrong doings. The proposed bill had provisions that allowed for probe and punishment to anyone found guilty even ten years after quitting the highest office of the prime minister or of a cabinet minister.
The bill would have ushered in a change in the entire system, including the police, judges and politicians. Today everything is being traded for holding on to power.
Earlier, as the finance minister I was expected to give a 700-million-dollar bail out package for a company associated with Mahathir’s son. I turned down the decision. Since then my relations with Mahathir were tense. I was sacked. And the opposition has stayed on with present government being headed by Najib.

Ahead of the 2013 elections what are the challenges?
Malaysia, I feel, is living in a state of denial. We are failing to see where the world is going. It is time we decided whether we want a democracy or a dictatorial regime which is taking our nation backwards. There are Muslim countries that have taken to democracy. Are we going to take the example of progressive Turkey or repressive Burma and Zimbabwe. The people of Malaysia want reform and a promise of better life.

Are you anticipating early polls?Elections can take place any time between March and September (2013). The biggest challenge for my country is to fight corruption, which has become an epidemic, and undertake major reforms for democracy. We all look up to India which is the second largest populated country practicing democracy. People in Malaysia want change.

Reforms in political system, are we talking of inching towards democracy?Reforms are possible if free and fair elections are allowed in Malaysia. Do you know that the leader of opposition is not allowed even a single minute on the government-controlled television?

In the backdrop of global recession, how is Malaysia faring?

Global recession has certainly affected Malaysia, which has lead to export of petroleum and palm oil to America, China and India.
There is a problem of wasteful expenditure in the government which needs to be curbed. The GDP growth during my tenure as finance minister was 9 to 10%. However, since 1998, it showed a decline. It has come down to 6.7% at present.

You had proposed reforms in the economic policy which was dismissed as anti-Malay? Do you still support that idea?
I was in favour of dismantling the National Economic Policy (NEP) which gave preferential treatment to the Malays over the ethnic Chinese and Indians in education, housing and employment. I must explain I am not against Malays. In 1971, I had strongly supported the policy whose objective was to provide better economic conditions and education for Malays that were poor. However, after 40 years I think it is pointless to continue the policy as the funds are being diverted to the rich and powerful and not the needy in Malaysia.

Will this economic reform go against you in these elections?I have always believed in multi-culture and multi-ethnicity. I shall explain to the people how in the name of locals a handful of powerful politicians are misusing their money.

WHAT`S THE VALUE IN PROTON..?

Those who want to take over Proton must make it competitive, otherwise Malaysian car buyers will see their agony prolonged.

So, what is it that suitors are hoping to get by buying government corporation Khazanah Nasional’s 42.7% stake? Are they looking to make Proton world champions? Unlikely. What they hope to do is to make Proton profitable behind the tariff walls that still continue to exist.

By P. GUNASEGARAM, The Star

THERE are three key questions that come immediately to mind when we consider the recent fervour of news and trading over Proton Holdings Bhd.
First, what is it in Proton which is so valuable that the retinue of potential bidders is looking for? Second, can they really turn Proton into a local, regional and world champion? Finally doesn’t anybody care about the way the share price is moving with all this speculation?

We shall deal with each question in turn. Proton’s basic problems are well-known. It lacks expertise, does not have sufficient access to expertise, which an alliance with a major manufacturer would have given it and it does not have scale to give it lower production cost per vehicle and make it competitive internationally.
That it has been enormously profitable at times previously is due to one fact and one fact alone – it has been able to sell its cars at expensive prices to Malaysians behind high tariff barriers which kept prices of similar cars prohibitively expensive.

It was knocked off its perch as the top local car company by the second national car company Perodua whose models now outsell Proton’s and are generally considered to be superior to Proton’s. Perodua has an equity and technical tie-up with Daihatsu of Japan, the Toyota subsidiary that specialises in smaller cars.
So, what is it that suitors are hoping to get by buying government corporation Khazanah Nasional’s 42.7% stake? Are they looking to make Proton world champions? Unlikely. What they hope to do is to make Proton profitable behind the tariff walls that still continue to exist.

You can bet they will ask for concessions and protection because none of them have the ability or depth of expertise and capacity to save Proton and make it internationally competitive.
Yes, but they can tie up with international partners much like the arrangement Perodua has. Yes, and that would be Proton’s best bet. But my question is why can’t Khazanah Nasional do that. It came tantalisingly close with Volkswagen in 2006 but the deal was aborted at the last minute due to powerful representations to the then Prime Minister Tun Abdullah Ahmad Badawi.

But there’s no reason why it can’t do that now – it has been five years since the deal with VW was aborted. That will make the government, as the owner of Khazanah Nasional, the beneficiary of the change.
Meantime, with all that speculation, the price of Proton has hit the roof and is at a 4-year high. Why that is so is a bit of a mystery. If one tracks the many changes of ownership in that key stake in Proton since its inception in 1983, not one involved a general offer.

I repeat, parties who have assumed control of Proton in the past have all not been required to make a general offer despite taking controlling stakes.

Perhaps the regulatory authorities in some new-found wisdom – there is definitely a case for a new controlling shareholder to make a GO – may require one. If that’s so, minority shareholders will benefit. But don’t bet on it.

There are ways that regulations and codes can be circumvented. One simple means is to break up that Khazanah Nasional stake. If a stake of under 33% is sold, then the acquiring party might argue that the Takeover Code has not been breached.

Khazanah Nasional could choose to keep the remaining stake and move into the role of a passive investor or place that out to other parties and get out of Proton completely.

But if a responsible disposal is what Khazanah Nasional wants – and considering that Proton is a national car project – it may want to ensure that the plans being put up by the prospective parties is indeed workable and does not prolong the long suffering of Malaysian car owners.

Whoever takes over, it must be made clear that there will be no concession and no bailout. But that’s not something that any government will be prepared to do. There is too much money, effort and pride invested in this and when push comes to shove, a bailout will be inevitable if things don’t turn out right.

Under the circumstances the best thing to do is for Khazanah Nasional to do what it is supposed to do – restructure government companies so that they can be regional and international champions.

If a tie-up with foreigners is necessary and giving car-manufacturing over to foreign control is part of the deal, so be it. Control can be held over other things such as local distribution. This is not ground-breaking – there is exactly such an arrangement with Perodua.

And once everything is market oriented and Proton has a decent chance with expertise and other resources from some major car manufacturer, the tariff barriers can come down and Malaysians will finally get a respite from ridiculously high car prices.

·P. Gunasegaram still feels like pulling his meagre hair and fuller white beard out when he thinks of the opportunity Proton missed to tie up with VW. Just imagine, a full-specs VW Golf GTI equivalent to not much more than RM100,000! Don’t laugh, that’s what it costs in Germany.

ANWAR IBRAHIM THE GAME-CHANGER

The outcome of his trial "vindicates Anwar and significantly removes doubts about his personal conduct, which had been a concern especially among conservative Muslim voters," said Ibrahim Suffian, head of polling outfit Merdeka Centre.

Business Recorder

Charismatic opposition leader Anwar Ibrahim's acquittal in a frame-up case throws open the political future of Malaysia, uninterruptedly ruled by the Barisan Nasional coalition for almost half a century.

So deep is the prevailing cynicism there, thanks to the government's domineering presence that he would walk free once again, he did not expect, nor his supporters.

Earlier too, he was imprisoned by his friend-turned-enemy Prime Minister Mahathir Mohammad on similar charges, the widely seen then as politically motivated.

Now that he is free and has promised to revive his political career, he tends to emerge as the strongest-ever challenge to the ruling coalition.
The rainbow opposition coalition, Pakatan Rakyat (People's Alliance), has the desired potential to do that as it proved in the general election in 2008.

Now that he would be leading it in person, he is expected to do even better in the election scheduled for early next year.

The charges against him were fabricated to keep him out of Malaysian politics, and the credit goes to the rising clout of institutions.

The judiciary is bolder than ever before and Prime Minister Najib Razak too seems to be eager on delivering his oft-repeated pledges of reforms to civil liberties.

But it was Anwar Ibrahim's supporters who thronged the streets of Kuala Lumpur, shouting the opposition's battle cry "Reformasi".

The 'spring' that is buffeting the Arab World, and has already arrived in Pakistan, now seems to be making its way to the Far East with Malaysia seemingly its first destination. It was Anwar Ibrahim's market-friendly policies that ushered in the economic prosperity that earned Malaysia the brand of an Asian Tiger.

But sensing that his deputy premier has the right potential to become threat to his position Mahathir Mohammad sacked him, following it up with the usual Third World-specific treatment of political opponents.

But for his wife Wan Azizah Wan Ismail's iconic fight against the frame-up that kept Anwar Ibrahim's plight at the hands of his erstwhile friend and mentor alive.

Now that an air of change is sweeping across Malaysia and its multi-ethnic society appears receptive of it here cometh the hour cometh the man.

Anwar Ibrahim has to 'reinvent' himself, mainly by overlooking his victimisation and he has the capacity to do so.

The outcome of his trial "vindicates Anwar and significantly removes doubts about his personal conduct, which had been a concern especially among conservative Muslim voters," said Ibrahim Suffian, head of polling outfit Merdeka Centre.

Looking to the future Anwar Ibrahim's "only concern is now to ensure that the elections are held free and fair".

That he can turn the tables on the ruling coalition he is confident, his success expected to be more spectacular than in 2008 when even from behind the bars he could seize control of five states (provinces) and one-third of the parliamentary seats.

AMANAT TERAKHIR DATO` SERI ANWAR IBRAHIM SEBELUM KE MAHKAMAH JALAN DUTA 901

Assalamualaikum warahmatullahi wabarakatuh

ANWAR IBRAHIM

=========
Come tomorrow, the 9th January 2011, the judgement of the Sodomy II case will go down in history as a defining moment or indeed a day of infamy in the fight for justice and a better Malaysia.
I call on my fellow Malaysians to remain firm and committed in their clamour for political reform. They can assassinate my character, trample on our rights, they can put us behind bars for speaking up and they can even beat us up just for being together but they can never take away our dignity and our spirit to do what is right and fight for what we believe in.
Beginning from the first heinous plot back in 1998, they then repeated this bare and scurrilous allegation against me three and half years ago and since then have launched relentless attacks on my character. Throughout this sham trial, the people have seen how the police, the prosecution and the judiciary and the UMNO controlled media are working together to secure the continuation of this corrupt BN government.
Whatever the judgement may be, let us renew our conviction to bring about change – to uphold the rule of law, to have a fair and equitable economic system and to foster a true spirit of brotherhood among all Malaysians. We must remain steadfast in our fight against corruption, abuse of power, oppression and tyranny.

Rest assured that in the coming 13th General Elections, the voice of the people will be heard and this corrupt and arrogant government will be toppled from their pedestals of power.
They can put me in a cage and chain me to the ground but they can never imprison my soul and my spirit. I make this solemn promise to you that I will not rest until we make right the wrongs committed by this corrupt government and bring about a just and equitable nation.
I will remain with you in heart and soul and together we will build a new Malaysia.

WALL STREET JOURNAL:THE ANWAR VERDICT

Wall Street Journal
A chance for Obama to speak up for the rule of law in a Muslim ally.

We have a stake not just in the stability of nations, but in the self-determination of individuals.” That was President Obama at the State Department last May, rolling out his own version of the freedom agenda for the Muslim world. So why has the Administration been virtually silent when it comes to one of the most notorious and long-running abuses of power taking place in the Muslim world today—this one in our good friend and ally, Malaysia?

The abuses in question concern Malaysian opposition leader Anwar Ibrahim, who on Monday faces a verdict—and potentially years of jail time—on dubious sodomy charges. Mr. Anwar first went through this charade as a deputy prime minister in the late 1990s, when he fell out with then-Prime Minister Mahathir Mohamad during the Asian financial crisis, was savagely beaten by police and ultimately sentenced to prison on sodomy and corruption charges.

Mr. Anwar spent six years in prison. In 2004 the sodomy charges were overturned by the country’s highest court—a year after Mr. Mahathir had left office. Yet Mr. Anwar was again served with sodomy charges four years later, after the ruling UMNO party had lost its two-thirds majority and the opposition seemed close to assembling a parliamentary majority.

The current case is even flimsier than the last one. It is based mainly on the word of one accuser who, as it so happened, had met with then-deputy prime minister, now Prime Minister, Najib Razak days before the alleged incident. Doctors at two hospitals could find no evidence of rape in the aftermath of the alleged incident. Nonetheless, political observers anticipate a guilty verdict.

This is happening in the context of growing discontent among Malaysians with UMNO’s ruling order, and Mr. Najib’s ambivalent attempts at political reform. But if that’s reminiscent of the unhappiness that presaged the Arab Spring, so too is the don’t-rock-the-boat attitude of the Obama Administration.

Malaysia is supposedly a moderate Muslim country and a useful regional counterweight to China, and the President was full of praise for Mr. Najib’s “great leadership” when they last met in November. As for Mr. Anwar, the State Department has publicly offered no more than boilerplate about his case. Perhaps quiet diplomacy is now at work on Mr. Anwar’s behalf, but that kind of diplomacy is fine only as long as it produces results.

In the meantime, Malaysian democracy could benefit from a sign that the U.S. is not indifferent to Mr. Anwar’s legal ordeal or to the political system that has allowed it to continue. U.S. interests could benefit as well. “Failure to speak to the broader aspirations of ordinary people will only feed the suspicion that has festered for years that the United States pursues our own interests at their expense,” said Mr. Obama in May. Mr. Anwar’s case gives the President a chance to show that he meant what he said.

Safwan koma dibelasah

Menurut sumber, tragedi berdarah awal pagi tadi berlaku setelah Pengerusi Gerakan Menuntut Kebebasan Akademik (BEBAS), Muhammad Safwan Anang tidak mengendahkan arahan pihak polis supaya bersurai.

Tujuh belas siswa ditangkap

“Mengapa kami diperlakukan sebegini rupa?

– GZDaily
